HEARING ON APPEAL

NOTICE is hereby given of a public hearing to be held before the Zoning Board of Appeals of the Town of Amherst, Erie County, New York, at the Amherst Municipal Building, 5583 Main Street in the Village of Williamsville, Erie County, New York, on Tuesday, March 20, 2018, at 6:30 o’clock P.M. to hear all persons interested in an appeal taken by Bell Atlantic Systems of Allentown, Inc. d/b/a Verizon Wireless, c/o Jared Lusk, Esq., 1300 Clinton Square, Rochester, NY 14604, requesting a special use permit to the Town of Amherst Zoning Ordinance for an existing wireless telecommunication facility and five waivers at 2700 Millersport Highway.

The foregoing notice is given pursuant to Section 8-2, Sub. 8-2-3B of the Zoning Ordinance of the Town of Amherst, New York, and pursuant to order of the Zoning Board of Appeals of the Town of Amherst, New York. All persons interested in said appeal are requested to appear at the time and place fixed hereinabove for said appeal.

Waiver to 6-7-3 G(20) – Certifica- tion that a topographic and geomorphologic study and analysis has been conducted, and that taking into account the subsurface and substrate, and the proposed drainage plan, that the site is adequate to assure the stability of the proposed Wireless Telecommunication Facilities on the proposed site.

Waiver to 6-7-3 M(1) – A “Zone of Visibility Map” which shall be provided in order to determine locations from which the Wireless Telecommunication Facility may be seen.

Waiver to 6-7-3 AA – The petitioner will provide a written copy of an analysis, completed by a qualified individual or organization, to determine if the tower or existing structure intended to support wireless facilities requires lighting under Federal Aviation Administration (FAA) Regulation Part 77. This requirement shall be for any new tower or for any existing structure or building where the application increases the height of the structure or building. If this analysis determines that the FAA must be contacted, then all filings with the FAA, all responses from the FAA and any related correspondence shall be provided in a timely manner.

Waiver to 6-7-7 E – Visual screening, including but not limited to landscaping, walls and fences, shall be approved by the ZBA. The Town's landscape architect and consultant shall provide recommendations to the ZBA regarding visual screening.

Waiver to 6-7-10 – Lot Size and Setbacks. All proposed towers not mounted on existing buildings or structures and any other proposed WTF structures shall be set back from abutting parcels, recorded rights-of-way and road and street lines by the greater of the following distances: A distance equal to the height of the proposed tower or WTF structure plus 10 percent of the height of the tower or structure, or the existing setback requirement of the underlying zoning district, whichever is greater. In addition, the facility shall be separated from residential property lines, school property lines, designated historical districts, historical landmarks and historical sites by the minimum distance of 500 feet. The ZBA may modify this condition if the facility is attached to an existing nonresidential structure, or if an easement has been granted or other agreement with all property owners within 500 feet has been reached. In an agricultural district, the WTF shall be located a minimum of 500 feet from any dwelling unit. Any accessory structure shall be located so as to comply with the applicable minimum setback requirements for the property on which it is situated.

PLEASE TAKE NOTICE that on March 5, 2018, the Town Board of the Town of Amherst, in the County of Erie, New York, adopted a bond resolution entitled: “Bond Resolution of the Town of Amherst, New York, adopted March 5, 2018, authorizing the construction of security and building improvements at the Police and Court facilities, stating the estimated maximum cost thereof is $100,000, appropriating said amount for such purpose, and authorizing the issuance of bonds in the principal amount of $100,000 to finance said appropriation,” an abstract of which bond resolution concisely stating the purpose and effect thereof, being as follows:

FIRST: AUTHORIZING said Town to construct security and building improvements at the Police and Court facilities, as described in the map, plan and report dated February 2018, prepared by the Town Engineering Department (Project PO-5); STATING the estimated maximum cost thereof, including preliminary costs, and costs incidental thereto and the financing thereof, is $100,000; APPROPRIATING said amount for such purpose; and STATING the plan of financing includes the issuance of bonds in the principal amount of $100,000 to finance said appropriation, and the levy and collection of taxes on all the taxable real property in the Town to pay the principal of said bonds and the interest thereon;

SECOND: AUTHORIZING the issuance of bonds in the principal amount of $100,000 pursuant to the Local Finance Law of the State of New York (the “Law”) to finance said appropriation;

Waiver to 6-7-8 B – All antennae, towers and auxiliary structures shall be properly bonded and grounded to protect the facility and surrounding properties from lightning discharges.

Erie County Sewer District No. 6 is an exempt organization under the Tax Law, and is exempt from payment of Sales and Compensating Use Taxes which are to be incorporated into the project and which are to be separately sold by the Contractors to the Owner prior to incorporation into the project, pursuant to the provisions of the contract. These taxes are not to be included in the bid. Sales tax will be due on all materials purchased by a Contractor which are either “consumable” or rental property used by the Contractor in connection with the construction or repair.

Each proposal must be accompanied by a certified check payable to the Erie County Comptroller or by a bid bond having a surety thereon from a surety company acceptable to the County Attorney, in an amount not less than five percent (5%) of the total base bid, as surety for execution of the contract.

The successful bidder will be required to furnish Payment and Performance Bond, each in an amount equal to 100 percent of the contract award.

Attention of the bidder is called particularly to requirements with respect to conditions of employment to be observed, minimum wages rates to be paid under the contract, Affirmative Action requirements for Equal Employment Opportunity, along with the Minority Business Enterprise Utilization Commitment. Bidders are also advised that Part “A” of the Erie county Minority Business Enterp rise/Women’s Business Enterprise Utilization Report be submitted with the bid or no later than three (3) business days after the bid opening.
