The New York State Office of Mental Retardation and Developmental Disabilities has determined that the above Intermediate Care Facility for the Mentally Retarded (ICF/MR) is not in compliance with Medicaid Regulations under Title XIX of the Federal Social Security Act.

In accordance with 42 CFR 442.40(b)(2)(i) the facility will not be eligible for federal financial participation after November 7, 2011. The facility is required to cooperate with OMRDD in the orderly transition of Medicaid recipients from the facility, if necessary.
